McLellan RV Rental Terms for travel between 01-Jan-2007 and 31-Dec-2009
Renter must be 25 years of age or older and have a major credit card,valid driver's license, and full coverage insurance in his/her name or take out our insurance. Please read the following Policies and Conditions carefully. It forms any rental agreement you make with McLellan RV.
Rental prices, Policies and Conditions are subject to change without notice.
Rental Payment:
A down payment equivalent to approx 15% of the total booking is payable at the time of reservation. The balance of the rental payment and the $750 / $1000 refundable security deposit is due at time of pick up. The refundable security deposit will be refunded when the unit is dropped off in the same condition as when it was picked up, and up to 10 days after rental return. We may use this deposit to pay any amounts owed to us under this agreement. Payment can be made by check or credit card.
Cancellation Fee:
The initial deposit paid is non-refundable. In addition to forfeiting your deposit, the following charges also apply:
If the rental is cancelled within 60 days before the pickup date, a further $250 cancellation fee will apply.
If the rental is cancelled within 14 days of the pickup date or is a no show, full payment is due and will be charged to your credit card.
Travel insurance
We strongly recommend that clients ensure they take out the highest level of travel insurance. In many cases this will cover any losses incurred if you are forced to cancel your booking.
Pick up time:
Pick up is by appointment at our storage facility. The pickup time must be pre-arranged.
Return time is between 9am – 12 on the day of return.
Renter agrees to pay a late fee of $75 per hour for every 1hour period after 3:00PM up to a maximum of $500.00 per day. If renter is late and delays the departure, or cancellation occurs of the next renter, then renter is responsible for any inconvenience fees or loss of revenue, whichever is greater. Any extensions of rental or late returns must be approved by us. Early return times may be pre-arranged. There are no refunds for early returns. You must call us to confirm the pre-arranged pickup time.
Return of RV. Renter agrees to fill fuel tanks, fill propane tanks to level when rented, empty toilet and holding tanks, or pay the following charges:
Fill Fuel tanks - $10.00 + cost of fuel
Fill Propane tank - $10.00 + cost of fuel
Dump holding tanks - $50.00
The RV must be returned clean inside and out. If the RV is not returned clean inside and out, a $50 per hour cleaning fee will be charged, up to $150. Renter must pick up & drop off the rental RV him or herself. No Exceptions!
Travel Areas:
The RV is not to be driven outside of the contiguous USA and Canada. No trips to Mexico. During the winter months we do not recommend that you travel to or through snow areas, use snow chains, or travel where the weather is below freezing. Tire chains can damage tires if not properly installed and the holding tanks may freeze and burst, the renter will be responsible to pay for any damages caused and any loss of revenue until the RV is able to be rented again.
Vehicles are restricted from operation in Death Valley and other desert areas during hot periods. Damage waivers are voided should this rule be violated. Customer will also be held liable for all damages to vehicle, tires, towing charges, and all other related expenses as a result of a breakdown associated with operating in these areas. During certain periods, these areas are not habitable and could pose a danger to the customer and passengers. Please consult the sales office for restricted areas and times.
Vehicles are not allowed on "logging" and other non-public roads, and selected highways such as the Apache Trail in Arizona.
Due to restrictions on vehicle heights, propane gas and parking, vehicles with propane are not permitted to travel through any underground or underwater tunnels. Violations of these restrictions void damage waivers and customer may also be held liable for all damages and all other related expenses.
On Road Problems:
If you experience mechanical problems or have equipment operation questions you should refer to the Rental Assistance Guide provided to you at the time of departure. If the problem persists or you have concerns, please call us. Renter must call us for assistance to help with all concerns and mechanical problems. If renter does not call us with their concerns, we will not compensate renter for non - use of the RV if the renter was unable to sleep, cook, or use the bathroom facilities in the RV. No reimbursement for out of pocket expenses will be paid to renter unless prior authorization has been given by us and receipts of repairs are given to us on return. If renter is at fault for any damage, or mechanical failure, renter will be responsible for the entire contract and any loss of future rental income caused by the renter.
Smoking and Pet Policy:
There is No Smoking in any of the RVs. Pets are generally not allowed. If the RV is returned with smoke, pet hair or pet odor, additional charges will apply to the rental contract. Costs may vary.
Renter Damage:
If the RV is returned with damage while the RV was in possession of the renter, renter is responsible to pay all damage costs whether the renter was at fault or not or if damage was caused by acts of nature (Wind, rain, earthquake, fire, flood, etc). If an accident occurs, renter is responsible for obtaining a police report, contacting the renter's insurance company and contacting us immediately.
Renter(s) Who's names appear on contract are the only authorized drivers. If renter wishes to have additional drivers , renter must contact us for approval. If approved, additional driver's must obtain an insurance endorsement from their insurance company and provide it to us. All Mclellan RV's policies and conditions apply to additional drivers. The renter (Name on contract) is responsible for all rental costs and any and all damages. Renters with an insurance endorsement will need to go through their insurance company for reimbursement. If damage amounts are substantial and a claim must be submitted, and renter is responsible for any and all damages, loss of revenue, or additional expenses not covered by insurance. Check in time may take up 2 hours for damage estimating, please allow yourself enough time. McLellan RV will estimate the damage and expedite the repairs.
Liability Insurance:
You are responsible for all damage or loss caused to others. You have provided us with an insurance binder indicating that you have vehicle liability, collision and comprehensive insurance covering you, us and the vehicle. Since you have auto liability insurance, we provide no liability insurance.
MBA Choice.
If you did not provide us with an insurance binder but elected to purchase MBA Choice, the following changes apply to this agreement:
1. “Damage” means any collision or comprehensive loss to, or of, the vehicle; collision or comprehensive losses do not include damage to the interior to the vehicle or its appliances.
2. Damage to the vehicle is covered by MBA Choice. The policy has a deductible per occurrence.
3. Auto liability insurance is part of MBA Choice, and provides coverage for bodily injury and property damage with limits no higher than the minimum levels required by the vehicular financial responsibility laws of the state where the damage or loss occurs. MBA Choice covers $2000 PIP or medical payments and statutory limits of uninsured and under insured motorist coverage. Coverage applies in the United States, its territories, positions and Canada. Coverage is void if you violate the terms of this agreement or if you fail to cooperate in any loss investigation conducted by us or the insurer. Allowing unauthorized drivers to operate the vehicle terminates our liability coverage.
Appliances:
The A/C, Awning, Radio, Microwave etc. are convenience items. If any malfunctions should occur with any of these items, no compensation will be made to the renter. For assistance, renters are advised to consult the Renter Assistance Guide provided at the time of departure. If problems persist, please call us.
Tires:
Tires are the responsibility of the renter. In the event of a tire failure the renter is responsible for replacing the tire with the same type and bringing back the original tire to Mclellan RV along with a receipt for the new tire. Do not change the tire yourself!
Dry Camping is not advised:
When the renter is "Dry Camping" (not connected to an external power source), problems will most likely arise due to a low battery or failure. The battery will continue to stay low until renter is connected to an external power source. Mclellan RV is not responsible for the battery being low or any appliance malfunctions of the vehicle due to dry camping, NO reimbursements will be given for "Dry Camping Malfunctions".
Early Returns / Extending Rental Dates:
Renter is responsible for looking over the rental contract to ensure that all rentals costs and rental dates are correct before they leave on their rental. There are NO refunds for early returns. If renter does not return on their scheduled return date and has not called McLellan RV for approval to extend, renter will be charged additional rental day (s), inconvenience fees, or loss of revenue whichever is greater.
Parking/Traffic Violations:
Renter is responsible for reporting and payment of all parking/traffic violations at rental return. Non- reporting of parking/traffic violations breaches the Rental Contract and may result in an administrative charge of up to $100 in addition to the fines.
Late Pick Ups:
No refunds will be given for late pick ups.
Mileage charges:
All rentals include 100 free miles per day. Additional mileage charges are 101-200 miles per day - 30 cents per mile, 201 -300 miles per day - 60 cents per mile, 300+ miles per day - $1.00 per mile.
Generator:
Charges All rentals include 5 free generator hours per day. Additional hours will be charged $4.00 per hour.
Minimum rental period:
5 night minimum rental period required for all Major Holidays (Easter, Spring break, Memorial day, Labor day, Thanksgiving, etc.) and between May 22nd to Sept 11th. All other times have a 3 night minimum rental period. Long term rentals: 31 days + please call for availability and pricing. Corporate rentals please call for pricing. RV wrapping also available for corporate leasing.
Unit Availability:
Mclellan RV is not responsible for any charges related to the non-availability of a unit for reasons beyond our control i.e. breakdown or late returns. We are only liable for the amount of deposit and/or any fees paid to McLellan RV.
Towing:
Towing is not allowed unless pre authorized by us. Additional charges may be levied depending on the trailer weight. At no time shall any towed vehicle exceed 3000lbs total weight or 300lbs tongue weight. The towing hitch will be locked unless you advise to the contrary.
Exterior Storage
Storing items on vehicle roof or exteriors is NOT permitted.
Compensation for lost travel time:
This is at the discretion of Mclellan RV. We will work fairly in order to provide reimbursement for lost travel time, break downs or malfunctions which occurred whilst on your trip.

Basic Convenience Kit:
Included in rental, it contains: Coffee Pot, Toaster, 6 Dinner Plates, 6 Bowls, 6 Plates, Pan Set, Silverware, Cooking Utensils, RV Toilet Tissue, and Toilet Chemicals.
Personal Convenience Kit:
$40.00/per person/per trip, it contains: Bath Towel, Hand Towel, Wash Cloth, Sheet Sets For Appropriate Beds, Pillow, and Blanket.
Optional Pre-Paid Cleaning Fee:
You can ask for Quote, Choose to return Motorhome and we will evacuate all holding tanks, clean inside and out so you don’t have to.
Towing Fee:
$95.00 per trip Maximum 3500lbs (Select Vehicles Only) Please Ask At Time Of Booking.
Child Seat
$25.00 per trip
Baby Cot
$25.00 per trip Cot, it contains: Blanket, and Sheet Set
Bike Rack
$25.00 per trip, each motorhome can hold 4 bikes maximum.

The rates on this website are often heavily discounted. This is due to our negotiated rates and bulk buying power. On very rare occasions, a rate may be displayed incorrectly due to our, or a vehicle supplier's error. In such a case, if you book with us at a quoted rate that is incorrect, we will notify you of any price change and give you the option to proceed or cancel. We make every effort to keep information on our site up to date, but we cannot guarantee this website is free of errors or omissions and retain the right to update or change the information published at any time.
Liability
To the extent permitted by law we/the owners of this website will not be liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect or consequential loss or damage (including but not limited to any accident, injury, delay or loss of enjoyment) arising out of your reliance upon information contained on this website, including but not limited to your use (or inability to use) any products or services described or procured through this website.
When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.
While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.
Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.
Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.
A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.
If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.
Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.
Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.
Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
McLellan RV Insurance
